Georgia HOA violation notice letter template

Boards most often get enforcement notices wrong on process. For Georgia associations, Georgia Property Owners' Association Act (O.C.G.A. §§ 44-3-220–235) addresses enforcement procedures. Your governing documents add their own rules. They cover what a notice must contain and how you must deliver it. They also cover the owner's chance to respond or cure before fines or further action.

How to use it

  1. Describe the condition with facts only. Quote the governing-document provision exactly. Opinion and irritation have no place in an enforcement file.
  2. Fill in the cure period and hearing-rights language from your own documents and state statute. This part varies most and matters most. When in doubt, have association counsel approve your standard letter once. Then reuse it.
  3. Use the delivery method your documents or statute require. Log every notice in the association records: date, method, and a photo of the condition.
  4. Send the same letter, on the same timeline, with the same follow-up, to every owner. Uneven enforcement is the fastest way to lose the community and the case.

Georgia law on HOA violation notices

Georgia associations that adopted the Property Owners' Association Act look to O.C.G.A. §§ 44-3-220 through 44-3-235, including Section 44-3-223. Read the act itself at the official link below. Your declaration and rules contain most of the enforcement detail.

Follow your own procedures exactly. If your declaration requires written notice and a hearing, provide both. Skipping a step invites a challenge. Enforce the same rules the same way for every owner.

Cure period and hearing rights in Georgia

Careful Georgia boards follow a process like this before any fine:

  1. Written notice. Send a written notice that describes the violation and cites the governing document provision.
  2. Cure period. Most declarations require a period for the owner to fix the problem. Check your documents for the length.
  3. Hearing. Many Georgia declarations require a hearing before fines. Follow the procedure in your documents exactly.

Is a violation letter the same as an HOA warning?
A warning is informal. A violation letter is the formal notice that starts the enforcement process. Many associations use a warning as a first step.
How many days does the owner have to correct the violation?
Your declaration or rules set the cure period. Most range from 10 to 30 days. Check your documents.
Can the association fine without a hearing?
Only if your declaration allows it. Many Georgia declarations require a hearing. Follow your documents exactly to avoid a challenge.
