What a good violation notice includes
Most enforcement disputes come down to process. A defensible notice has four parts.
- Factual description. State what was observed, when, and where. No opinions or characterizations.
- Governing document citation. Quote the exact provision the condition appears to violate.
- Cure period. Give the owner a specific deadline to correct the condition, per your documents and statute.
- Hearing or response rights. Include the notice of opportunity to be heard that your statute requires before fines or suspension.
